At the November 3, 2025 New England City Council meeting, there was a two-page List handout that was given to each of the City Councilmen present. This two-page List contained about 130 people who were supposed to have some violation, deficiency, or complaint regarding grass too tall, weeds, vehicles, boats, trailers, campers, motorhomes parked in their yard.

I wanted to see and have a copy of this two-page List, to see if I was on it, for what reason, and to share this List with other people. I looked up whether a handout at a City Council meeting was considered a Public Record, and I found out that it was.

On November 4, 2025 I sent an email to New England City Attorney Olivia Krebs making a Public Record Request, asking for this two-page List. She emailed me back saying that she would process my request.

On November 5, 2025 I received an email from New England City Attorney Olivia Krebs that contained two attachments. The first attachment contained a completely blacked-out List, every word on this List was blacked-out. The second attachment was an explanation of why this two-page List was blacked-out, citing North Dakota Century Code.

I was very, very angry. According to my research, the only reason that a Public Records Document could be denied, was if it contained purely personal or purely private information. This two-page List did not, it contained merely names and addresses of people, the same thing that you would find in a phone book.

When I looked up the North Dakota Century Code that was cited by New England City Attorney Olivia Krebs, this Century Code did not apply, and the wording of this Century Code was greatly changed in order to make it appear that it applied. I was even angrier about this. For instance, the Century Code that New England City Attorney Olivia Krebs cited to black-out all of the information completely, this Century Code applied to “Criminal intelligence information and criminal investigative information”…..by a “Criminal Justice Agency”, that has absolutely nothing to do whatsoever with a two-page List of grass too long, weeds, vehicles, boats, trailers, parked in someone’s yard compiled by a New England City Councilman.

RE:  Illegal and Unethical Conduct by Attorney Olivia Krebs

I am alleging Illegal and Unethical Conduct by Dickinson, North Dakota based Attorney Olivia Krebs.  This conduct is alleged to have occurred by her Illegal Denial of my Public Records Request, Falsely Citing Fake North Dakota Century Code to deliberately intentionally deceive a lay-person, and doing so for Unethical Reasons.

Background:

I reside in New England, North Dakota and have attended every New England City Council meeting for the past two years.  I am usually the only member of the public present at these meetings.  At the October 2025 New England City Council meeting, there was a great deal of discussion by Council members about a List of 130 people compiled by City Councilman Chris Fitterer consisting of supposed violations of grass too tall, weeds, vehicles, boats, trailers, campers parked in people’s yards.

At the November 3, 2025 New England City Council meeting, this two-page List of 130 people supposed to be in violation, was distributed to all City Council members present.  There was some discussion about this two-page List, whether warning letters should be sent to these 130 people supposed to be in violation, and when fines should be assessed.

I wanted to see this two-page List to see if I was on it, for what reason, and be able to share this two-page List with people who did not attend this City Council meeting in order for them to have this information, to be aware, to possibly correct a violation beforehand, and prepare themselves.

On the following day, November 4, I emailed a Public Records Request to New England City Attorney Olivia Krebs, and she emailed me back stating that she would process my Public Records Request.  I had done some research to determine that a handout at a City Council meeting is a Public Record subject to Public Records Law.

Alleged Illegal and Unethical Conduct:

On November 5, 2025 I received an email from New England City Attorney Olivia Krebs.  She attached a completely blacked-out two-page List.  My Public Records Request was not fulfilled, and I believe that this was done in violation of Public Records Laws, and done solely because of pressure from City Councilman Chris Fitterer who compiled this two-page List.

***She attached a brief explanation for the completely blacked-out List, citing Two False Fake North Dakota Century Code Excerpts that she fabricated in order to deliberately intentionally deceive a lay-person.

***I want to be as absolutely clear as I can be:  the first North Dakota Century Code that Attorney Olivia Krebs cited, she changed both the Heading and the Wording to make it appear as though this Century Code applied to this situation, when it did not.  The second North Dakota Century Code that Attorney Olivia Krebs cited, she claimed that it applied to this situation, but it did not.

Here is a cut and pasted exact email quote from Attorney Olivia Krebs:

“Enclosed are the records you requested. Some information is redacted because it is exempt information or is confidential under North Dakota law, as identified below: • N.D.C.C. § 44-04-18.7- Active criminal investigative information is not subject to discovery by open records request. While these matters are active, the information is redacted to exclude any investigative information used for code enforcement purposes. This includes active investigatory information under N.D.C.C. § 44-04- 19.”

***Please Note***  NDCC 44-04-18.7 in Real Life is Actually Titled: Criminal intelligence information and criminal investigative information- Nondisclosure.  This North Dakota Century Code has ABSOLUTELY NOTHING TO DO WITH A CITY COUNCILMAN MAKING OBSERVATIONS ABOUT GRASS TOO HIGH, WEEDS, OR VEHICLES, BOATS, TRAILERS PARKED IN SOMEONE’S YARD!  In Real Life this North Dakota Century Code goes on to refer only to a CRIMINAL JUSTICE AGENCY.   Attorney Olivia Krebs even throws into her FAKE FALSE Century Code a made-up line “code enforcement  purposes” that is not in the Real Life Actual Century Code.  Attorney Olivia Krebs completely made-up this FAKE FALSE North Dakota Century Code to try to deceive a lay-person.

Also, Attorney Olivia Krebs refers to NDCC 44-04-19 which in Real Life is Actually Titled “Access to public meetings” and has no relevance to a Public Records Request whatsoever, but NDCC 44-04-19.1 is in Real Life is Actually Titled “Open records and open meetings – Exemptions for attorney work product, attorney consultation, and negotiation preparation.”  However, the two-page List compiled by City Councilman Chris Fitterer is NOT IN ANY WAY AN ATTORNEY WORK PRODUCT.

In my opinion, due to pressure from City Councilman Chris Fitterer, my Public Records Request was illegally not fulfilled.  The email that Attorney Olivia Krebs sent to me trying to justify the two-page List being completely blacked-out, contained FALSE FAKE CENTURY CODE, the CENTURY CODE CITED DOES NOT APPLY TO THIS, THIS CENTURY CODE WAS FALSELY STATED, CONTAINING COMPLETELY FABRICATED WORDING, in order to deliberately intentionally deceive a lay-person.

I am forwarding a Copy of this Complaint to both the North Dakota Attorney General and the North Dakota Auditor because there is and has been a great deal of illegal conduct by the New England City Council that has now gone too far. This is only the tip-of-the-iceberg of what is happening.
